Instant Pilates Privacy Policy

The purpose of this policy is to inform the persons whose personal data is used by Instant Pilates, of the reasons for which they are used, the duration of their conservation, as well as the rights relating to this data. It also includes a policy related to cookies.

1. The person responsible for processing personal data in the context of the activities offered by Instant Pilates is Mr. Galante Raphaël, registered with the BCE:

2. Instant Pilates processes personal data such as your identification data (surname, first name, telephone number, e-mail address, date of birth) which are necessary in the context of its activities and which allow it to provide you with a quality.

When you communicate data relating to your health on your own initiative, Instant Pilates will only process it with your consent. In this case, Instant Pilates will ask you to sign a specific consent form. This form will inform you precisely of your rights relating to this particular processing.

 

3. The legal basis for data processing is:

  • The contract: Instant Pilates uses personal data to conclude and execute its contracts in order to offer you its services;

  • The legitimate interest pursued by Instant Pilates: Instant Pilates uses personal data to set up and develop its activities, optimize its management and defend its interests;

  • Your consent: if you refuse to provide certain data, Instant Pilates may be unable to provide its services;

 

4. Your data is processed for the following purposes:

  • Create, administer and complete your profile;

  • Manage your orders, registrations and payments;

  • Inform you by email or via our App of our services (schedules, courses, teachers, seminars, prices, etc.);

  • Organize our services in order to provide you with quality service;

  • Contact you and inform you of our new services or special events;

  • Contact you for prospecting purposes;

  • Process and answer your questions about the operation or services offered by Instant Pilates;

 

5. In order to fulfill the aforementioned purposes, the processed data may also be transmitted to the following recipients:

  • People in charge of individual or group lessons, workshops or special events organized by Instant Pilates;

  • Companies involved in the IT management of our website or our App;

  • Public authorities upon request and within the limits of what is permitted by law;

Instant Pilates has taken technical and organizational measures to protect the databases in which your data is stored.

 

6. Instant Pilates retains personal data collected for a period of 5 years after your last activity with Instant Pilates. Instant Pilates retains personal data relating to prospects for up to 1 year after the last contact with the prospect.

 

7. Persons affected by the processing of personal data have various rights, in particular:

  • the right of access: you can obtain information concerning the processing of your personal data as well as a copy of it;

  • the right of rectification: if your personal data is inaccurate or incomplete, you can demand that this personal data be modified;

  • the right to erasure: you can request the erasure of your personal data;

  • the right to limit processing: you can request the limitation of the processing of your personal data;

  • The right to object: you can object to the processing of your personal data for reasons relating to your specific situation;

8. Instant Pilates also uses cookies on its website.

Instant Pilates Terms of Service:

1. Preamble 
These General Conditions (hereinafter the GC) govern the conditions of subscription and use of the various subscriptions and package formulas or single courses offered by Instant-Pilates (Srl L'instant).
These general conditions apply to the Customer and the Subscriber.
The Parties to the Subscription Contract are (1) the beneficiary of the subscription, hereinafter the Subscriber, (2) the Payer, if different from the Subscriber, who is in this case responsible for the payment of the subscription and  Instant-Pilates (Srl Instant).
(3) who offers the Subscription, hereinafter www.insant-pilates.com
The signing of the GTC by the Subscriber and the Payer implies unreserved acceptance of these terms.

2. General 

By placing an order on the website, the buyer explicitly accepts the general conditions of sale which are at all times available on the website and agrees to each and every one of the conditions, whether general or specific.

Therefore, the buyer waives his own terms of purchase including payment terms and delivery terms. Any derogation must be made in writing and be expressly accepted by the seller. 

If the seller decides to modify his general conditions of sale, he will put the new version on his site. The buyer is therefore invited to regularly consult these general conditions of sale to be aware of any changes.

The general conditions of sale applicable will be those in force on the date of the order of  the buyer.

3.  Medical certificate 
Having completed the health questionnaire of  Instant-Pilates (Srl L'instant), the Subscriber certifies that his physical constitution and his state of health allow him to practice sport in general, 
and more particularly to use the services, activities, equipment and facilities offered by the instructor of which he acknowledges having perfect knowledge.
The Subscriber will be obliged to provide a medical certificate if  Instant Pilates  (Srl Moment).
the request according to the answers given to the "health questionnaire".
4. Different rates and duration of contracts  subscription, different formulas of group/individual lessons in the classroom or online 
4.1 Duration of subscription contracts 
Each subscription plan is  subject to an expiry date.
4.2. Subscription formulas 
The subscriber can pay for a single lesson for a first discovery session. 
If he wishes to continue he can choose a subscription formula offered by  Instant Pilates  (Srl The Moment) 

on the website www.instant-pilates.com
The subscriber is required to respect his commitment without possible refund.
4.3. Prices 
The applicable rates are those in force on the date of signature of the contract. The prices are indicated net including VAT For subscribers not subject to VAT.
The prices of single lessons and subscriptions depend on the lessons concerned (group or individual lessons in the classroom or online lessons) 
5. Payment 
Subscribers must pay their subscription formula in advance by credit card or PayPal on the online booking site.
www.instant-pilates.com or by bank transfer. 
No purchase by subscription can give rise to a refund.
6. Lessons: reservation and conditions for modification or cancellation 
The Subscriber cannot attend a group lesson without having reserved their place in advance on the online reservation system on the site www.instant-pilates.com or by telephone at 0483/000.850 or by email at raphael.galante @instant-pilates.com
A reservation for a group or private lesson can be canceled no later than 24 hours before the start of the lesson. In the event of non-compliance with the aforementioned cancellation deadlines by the Subscriber, the credit for his course will be lost and cannot give rise to a refund.
The Subscriber may cancel a reservation directly on the wwww.instant-pilates.com website, by email, by SMS or by telephone.
Instant-Pilates (Srl L'instant) reserves the right to modify the schedule of group lessons without notice. 
As far as possible, Subscribers will be informed of such a modification as soon as possible.
7. Terms of Termination/Suspension/Modification 
It is not possible to terminate a subscription and request a refund. Instant-Pilates (Srl L'instant) reserves the right to terminate or not renew a subscription  in the event that the Subscriber does not comply with any provision of these general conditions or the internal regulations.
8. Civil Liability/Bodily Injury 
Instant-Pilates (Srl L'instant) is insured for damages involving its civil liability and that of its personnel. 

The purpose of this insurance is to guarantee the Subscriber against the pecuniary consequences of civil liability incurred for damage caused to others as a result of the operation: bodily injury, material and immaterial damage.
The liability of Instant Pilates (Srl L'instant) cannot be sought in the event of an accident resulting from the Subscriber's failure to observe the safety instructions or the inappropriate use of the equipment or other installations.
The Subscriber is invited to take out a personal Civil Liability insurance policy covering him for all damages he may cause to third parties, by his own doing, during the exercise of the activities offered by "Instant Pilates".
Instant Pilates (Srl L'instant) informs the Subscriber of the interest of subscribing to a personal insurance contract covering the bodily injury to which their sporting practice may expose them.
9. Changing room 
In order to guarantee the security of the personal belongings of its Subscribers. The Subscriber thus acknowledges having been fully informed of the risks incurred by placing valuables in shared or individual locker rooms instead of the activity offered by "Instant Pilates". Therefore, Instant Pilates (Srl L'instant) cannot be held responsible for any theft or disappearance of personal effects.
10. Image rights 
The Subscriber gives the right to Instant Pilates to use his image through photos and videos of his person without compensation. 
In the event that the Subscriber refuses this use, he must notify the instructor of Instant Pilates (Srl L'instant) beforehand when signing the subscription form.

11. Applicable law - Jurisdiction 

All our sales, as well as these general conditions of sale are subject to Belgian law.

11.1 Dispute 

Any dispute arising from the execution of these general conditions of sale will be submitted to the Courts of the seller's registered office, except for binding public order provisions and subject to the possibility for the seller to act before the court of residence or buyer's seat.

12.Covid 
If a course cycle  (depending on the formula) is interrupted for reasons beyond our control (containment), it will not be refunded. However, the latter will either be postponed until later, or given virtually (when appropriate).
13. Intellectual Property 
- All the elements of this Site and the Site itself are protected by copyright, trademark law, designs and models and/or all other intellectual property rights. These elements are the exclusive property of the Company. All these rights are reserved for the whole world.
-The name and brand "Instant Pilates", logos, designs and models, stylized letters, figurative marks, and all signs represented on this Site are and will remain the exclusive property of the Company.
- No title or right to any element or software will be obtained by downloading or copying elements from this Site. It is strictly forbidden for the Customer to reproduce (except for his personal and non-commercial use), publish, edit, transmit, distribute, show, remove, delete, add to this Site and the elements and software it contains, no more modify them or perform any work based on them, nor sell or participate in any sale in connection with this Site, the elements of this Site or any software relating thereto.
-Any use by the Client of the corporate names, trademarks and distinct signs belonging to the Company is strictly prohibited except with the express and prior agreement of the Company.

All elements of the seller's site are and remain the exclusive intellectual property of the latter or of its partners and suppliers. No one is authorized to reproduce, exploit, redistribute, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or sound.
